LONG REACH LONG RIDERS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT In consideration of my participation as a driver and/or rider in the “2024 Long Reach Long Riders Motorcycle Ride” tentatively scheduled to occur June 15-22, 2024 through West Virginia (the “LRLR Ride”), I, the undersigned, for myself and my heirs, executors, administrators and assigns (a) release, waive, hold harmless, and discharge any and all claims for damages, for death, personal injury, loss of property or property damage I may have, or that may subsequently accrue to me, or to my heirs, executors, administrators or assigns, as a result of, or in any way related to my participation in any LRLR Ride, and (b) to the fullest extent permitted by applicable law, release, waive, hold harmless, discharge, and covenant not to sue, in advance, the promoters, sponsors, volunteers, donors and donees of the LRLR Ride, including, but not limited to, Behind the Scenes Foundation (“BTS”) and its respective officers, directors, agents, representatives, employees and members, from any and all causes of action, claims, liabilities, losses and damages arising out of or connected in any way with my participation in the LRLR Ride even though that liability may rise out of alleged negligence or carelessness on the part of the aforesaid persons or entities. I agree to indemnify and hold harmless each of the aforesaid released parties from any and all of the aforesaid causes of action, claims, liabilities, losses (including, without limitation, attorneys’ fees and costs) and damages. MY PARTICIPATION IN THE LRLR RIDE IS VOLUNTARY AND UNDERTAKEN AT MY OWN RISK. I FULLY UNDERSTAND THAT MOTORCYCLE RIDE EVENTS INVOLVE RISKS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH WHICH MAY BE CAUSED BY MY OWN ACTIONS OR INACTIONS, THOSE OF OTHERS (WHETHER PARTICIPATING IN THE EVENT OR NOT), AND WEATHER (INCLUDING, WITHOUT LIMITATION, HIGH HEAT, THUNDERSTORMS, LIGHTNING, PRECIPITATION, COLD TEMPERATURES, SNOW, HAIL, HIGH WINDS AND HUMIDITY), TRAFFIC, ROAD (INCLUDING, WITHOUT LIMITATION, UNEVEN OR WET ROAD SURFACES OR GRAVEL ON THE ROAD SURFACE) AND OTHER CONDITIONS (INCLUDING, WITHOUT LIMITATION, THE FAILURE OF OTHER BIKERS, VEHICLES AND NON-PARTICIPANTS TO OBSERVE TRAFFIC SIGNALS OR LAWS), AND I HEREBY VOLUNTARILY ASSUME ALL RISK OF LOSS, DAMAGE OR INJURY THAT MAY BE SUSTAINED WHILE PARTICIPATING IN THE LRLR RIDE. I attest that I am medically and physically able to participate in the LRLR Ride. If I experience any doubt as to my ability to successfully and safely participate in and/or complete the LRLR Ride, I take full responsibility for consulting a physician. I attest that, if I am pregnant, disabled in any way, or have recently suffered an illness, injury, or impairment, I should have consulted or did consult a physician prior to participating in the LRLR Ride. I consent to emergency medical care and transportation in the event of injury to me as medical professionals may deem appropriate. This Waiver and Release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency, including, but not limited to, negligent emergency rescue operations. I hereby grant full permission to the Long Reach Long Riders and BTS to use, reuse, reproduce, publish, or republish any photographs, motion pictures, audio and video recordings, or any other record of my participation in this event, in any medium now known or hereafter developed, alone or in conjunction with other material, without restriction as to changes or alterations, as well as to use my name, voice, likeness, and/or other indicia of identity, for editorial, educational, promotional, advertising, and commercial purposes, including without limitation in connection with the solicitation of contributions and the furtherance of the corporate objectives of BTS. This Waiver and Release contains the entire agreement between and among the parties to this Waiver and Release and applies to any and all LRLR Ride that I participate in from and after the date of this Agreement. I have read and understand everything written above and I voluntarily sign this Waiver and Release. The undersigned acknowledges and agrees that if any portion of this Waiver and Release is held invalid, that the balance shall, notwithstanding, continue in full legal force and effect.
